GENERAL

These terms and conditions apply to all purchase orders submitted to PAULA beachwear’s web shop on www.paulabeachwear.com (in the following referred to as the Webshop), covering all purchase agreements that a consumer enters into online with us. We encourage you to read these terms and conditions in their entirety before submitting an order. These terms and conditions may be updated and vary from time to time, which is why we ask you to read the terms and conditions previous to every order you place in the Webshop.

A binding purchase agreement is entered into as soon as your order has been confirmed by us and an order confirmation has been sent to the e-mail address you submitted. If an item happens to run out of stock before the status has been correctly updated on the Webshop, we will notify you of this by e-mail. We may then suggest an alternative item, or cancel the order in question and refund your purchase. If incorrect price information has been shown on the Webshop you will be given the opportunity to either purchase the item at the correct price or cancel the order. PAULA beachwear reserves the right to decline or rescind a purchase agreement if fraud or other actions similar to fraud, such as unlawful use of another person’s credit card, are suspected.

To place an order in the Webshop you must be at least 18 years old and not under guardianship. PAULA beachwear presumes that minors who carry out purchases on www.paulabeachwear.com submit truthful information of their age and/or possess the necessary consent from their custodian to purchase the item(s). If not, the buyer may become liable for the possible costs an invalid agreement may involve.

 

PERSONAL INFORMATION

All personal information you provide us with or that we obtain will be handled by PAULA beachwear as responsible for the personal information. The personal information you provide will be used to ensure deliveries to you, the credit assessment, to provide offers and information on our catalogue to you. The information you provide is only available to PAULA beachwear and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request PAULA beachwear to delete or correct the information held about you. By accepting the PAULA beachwear Conditions, you agree to the above.

 

FORCE MAJEURE

Events outside PAULA beachwear’s control, which is not reasonably foreseeable, shall be considered force majeure, meaning that PAULA beachwear is released from PAULA beachwear’s obligations to fulfill contractual agreements. Example of such events is government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

 

PRICES

Occasionally there may be information in the Webshop that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the Webshop is inaccurate at any time without prior notice (including after you have submitted your order).

The prices in our Webshop constitute the total price (including VAT), but do not include delivery costs or potential payment fees. Outside the European Union, customs fees or other taxes and charges may be added to the purchase price.

 

PAYMENT

Payment is possible in the currencies set out in the Webshop. Payment is currently made in Swedish kronor (SEK) for shipments to Sweden, Euro (€) for shipments within Europe and Dollars ($) for shipments to the United States and other non-European countries. Payment can be carried out by credit or debit cards, Klarna Invoice in some territories, or PayPal (local variations depending on shipping destination).

PAULA beachwear reserves the right to check the cardholder’s address, the card’s validity, and that your account has the capacity to be charged with the full amount. PAULA beachwear reserves the right to decline a purchase.

Please note we are currently unable to accept gift cards, merchandise cards, cash or checks as payment in the Webshop.

All products remain PAULA beachwear’s property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognized before confirming the purchase.

All transfers conducted through PAULA beachwear are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.

 

DELIVERY

PAULA beachwear accepts and processes the purchase orders in the same order as it’s submitted to the Webshop. The time of delivery is the day that the item is available for collection. Normally the time of delivery within Sweden is 2-5 business days (Mon-Fri) after PAULA beachwear has accepted and confirmed your order. For international shipments, delivery times are normally 2-5 business days (Mon-Fri) with DHL.

All shipping costs will be specified in the purchase order so that the cost is clearly visible to you prior to completing the order, but potential additional customs duties are not specified.

 

LOCAL TAXES

Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers’ own expense.

 

PACKAGES RETURNED AS UNDELIVERABLE

If a purchase sent to you is returned as undeliverable, we reserve the right to charge you a fee covering the entire cost of the shipping and processing. Non-collected packages are normally not covered by the right to return items as well as the returned order.

 

DELAY

Should your order be delayed you will receive a message of this, including a new suggested time of delivery, at the latest within 30 days after you submitted your order. You may cancel the order if you do not accept the new suggested time of delivery. If your order has been delayed, and the new suggested time of delivery has been accepted but the order has not yet been delivered within 15 working days after the new estimated time of delivery, you may always cancel the order by notifying our customer services team. If such a delay should occur, whereby you choose to cancel the order, we will repay the prepaid amount to you. If the order has already been dispatched you will have to return the ordered items in order to receive repayment. We will pay the cost of the return.

 

TRANSPORT

All dispatched items are insured by PAULA beachwear. Should you discover any damage to the package prior to opening it please report this PAULA beachwear Customer Care ([email protected]) and the postal agent where you collected the package, as soon as possible. Items that are damaged during transportation are replaced by PAULA beachwear free of charge. If you have already opened the package when you notice the damage, please follow the return, damage and claim instructions.

 

RETURNS AND EXCHANGES

You are always entitled to return your items within 30 days of receipt. Returns are at your expense. For all customers living outside the EU please contact us before return to receive freight labels from us.

For the return to be accepted the returned items must be in the same condition in which they were sold:

  • Proof of purchase provided
  • Tags attached
  • The garment in original condition, including unworn and unwashed
  • Please make sure that swimwear is tried on over your own underwear. In the interests of hygiene, we may refuse returns of items where it’s obvious that this hasn’t been done.
  • This does not apply if the items were damaged or otherwise changed due to any measure necessary to examine them, or due to any other circumstance not related to the consumer.

PAULA Beachwear will repay the price of the item as soon as possible, however at the latest within 30 days from the date the item was returned and received by us. The funds will be returned to your original method of payment. If you paid using your credit card, the amount will be repaid to the same card.

 

RETURN TO PAULA BEACHWEAR STORE

You may also exchange or return an item bought online in the PAULA beachwear store in Stockholm, within 30 days of receipt. To return an item bought online in the store you need to make an appointment by contacting us by email: [email protected]

 

COLOURS

We cannot guarantee that the colors appearing in the Webshop reflect the clothes’ colors in reality. The colors can be reflected in different ways depending on for example your computer or phone screen, graphics card and computer settings.
